In the past few years, a second phase of biomedical ethics in Japan has begun to surface with a succession of governmental guidelines and laws regulating biomedical technology. Although this rush of guidelines exemplifies a heightened awareness concerning ethical standards for healthcare research, it also invites several practical, political, and procedural problems.

Background Ethics committees and their system of research protocol peer-review are currently used worldwide. To ensure an international standard for research ethics and safety, however, data is needed on the quality and function of each nation's ethics committees. The purpose of this study was to describe the characteristics and developments of ethics committees established at medical schools and general hospitals in Japan. Methods This study consisted of four national surveys sent twice over a period of eight years to two separate (...) samples. The first target was the ethics committees of all 80 medical schools and the second target was all general hospitals with over 300 beds in Japan (n = 1457 in 1996 and n = 1491 in 2002). Instruments contained four sections: (1) committee structure, (2) frequency of annual meetings, (3) committee function, and (4) existence of a set of guidelines for the refusal of blood transfusion by Jehovah's Witnesses. Results Committee structure was overall interdisciplinary. Frequency of annual meetings increased significantly for both medical school and hospital ethics committees over the eight years. The primary activities for medical school and hospital ethics committees were research protocol reviews and policy making. Results also showed a significant increase in the use of ethical guidelines, particularly those related to the refusal of blood transfusion by Jehovah's Witnesses, among both medical school and hospital ethics committees. Conclusion Overall findings indicated a greater recognized degree of responsibilities and an increase in workload for Japanese ethics committees. (shrink)

Many thinkers have said that a God whose existence is argued for metaphysically would have no religious significance even if he existed. This book examines the God or Absolute which emerges in various metaphysical systems and asks whether he, she, or it could figure in any genuinely religious outlook. The systems studied are those of Spinoza, Hegel, T. H. Green, F. H. Bradley (very briefly), Bernard Bosanquet, Josiah Royce, A. N. Whitehead, Charles Hartshorne. There is also a chapter on Kierkegaard (...) as the most important critic of metaphysical religion (especially Hegelian Christianity). The book ends with a statement of a form of absolute or pantheistic idealism espoused by the author and an indication of what religious significance it may have. (shrink)

Gametes, tissue, and organs can be taken from the dying or dead for reproduction, transplantation, and research. Whole bodies as well as parts can be used for teaching anatomy. While these uses are diverse, they have an ethical consideration in common: the claims of the people whose bodies are used. Is some use permissible only when people have consented to the use, actually wanted the use, would have wanted the use, not opposed the use, or what? The aim of this (...) article is to make progress in answering these questions. Initially I assume knowledge of people’s desires in order to test whether consent is directly required by their rights without worrying about mistaken uses against their wishes. I claim consent is not directly required by people’s rights. If we know people wanted or would want a use, their rights permit the use, but if we know they wanted or would want not to be used, their rights do not permit the use. The knowledge assumption is then dropped and the question becomes how to decide what to do when the wishes of rightholders are not known. I suggest working out what to do when wishes are known and then adjusting, on the basis of whatever evidence there is, for probability and strength of desire. There are other considerations too, for instance about default rules. The key general comment here is that, in setting rules, the costs to rightholders in not getting what they want needs to be taken into account. The final section tries to show that, in setting these rules, mistaken uses are not to be taken as worse than mistaken failure to use. (shrink)

To compare a novel to a work of philosophy is, admittedly, a risky exercise in analogy. When the novelist is Lawrence and the philosophical text is the ponderous and dialectical Being and Nothingness, such a comparison may seem willfully perverse and peculiarly open, insofar as it deals with Lawrence's great theme of sexuality, to his anathema of "sex in the head." Furthermore, modern criticism, especially in the Anglo-Saxon world, has tended to be wary of critical approaches that lean on notions (...) that are not derived from literature itself - a tendency that is being reinforced these days by the structuralist insistence on the "literariness" of the Text. Now, despite its metaphorical statement as a form of dramatic "gesture," Sartre's book is very definitely not a work of literature. T.H. Adamowski, associate professor of English at Erindale College, the University of Toronto, has written articles on English, American, and French literature. I am pleased by the degree of agreement about reasons between the three of us, which is much greater than I might have guessed. I have no objection whatever to the project of giving the kind of psychological description of deliberation about reasons that Gibbard proposes. I agree that “weighing X in favor of A isn’t mysterious,” but I do confess to some doubt about how a psychological description of this process of weighing “explains, indirectly, X’s counting in favor of (...) A in such circumstances.” If there is any disagreement between Gibbard and me on this point, I think it is over the degree to which such an explanation is to be expected. (shrink)

Professor Benhabib seeks to rely upon discourse theory to ground a `right to membership' — a right of immigrants to seek and be granted naturalization. The effort is unpersuasive because discourse theory cannot provide an answer to the fundamental question of who should participate in the conversation that would establish a right to membership, nor is it clear that persons freely and equally discussing membership rules would reach the normative conclusions that Benhabib defends. Protection of the `rights of others' might (...) be better secured by arguing from human rights principles that guarantee rights to all residents — citizens and immigrants — than by arguing for a right to membership. Utilitarian ethics and metaphysical idealism, especially of a Bradleyan sort, are not usually thought of as natural allies. Yet when one considers that it is a crucial part of utilitarian doctrine that the only genuine value is experienced value and almost the definition of idealism that for it the only genuine reality is experienced reality one should surely suspect that the two views have a certain affinity. The essential impulse behind utilitarianism is the sense that the only criterion of something (...) really being intrinsically good is that it feels good. To the ordinary man to say that something feels good is much the same as saying that it is a pleasure, so that for him it is a small step from identifying good with what feels good to identifying it with pleasure. It suggests itself, then, that the utilitarian is essentially one who thinks that, so far as the good goes, esse ispercipi. In that case the utilitarian is an idealist about value. It does not follow that he should be an idealist about things in general, but it does suggest the converse, that the idealist about things in general might be expected to be a utilitarian in his ethics. We argue that abduction does not work in isolation from other inference mechanisms and illustrate this through an inference scheme designed to evaluate multiple hypotheses. We use game theory to relate the abductive system to actions that produce new information. To enable evaluation of the implications of this approach we have implemented the procedures used to calculate the impact of new information in a computer model. Experiments with this model display a number of features of collective belief-revision leading to consensus-formation, (...) such as the influence of bias and prejudice. The scheme of inferential calculations invokes a Peircian concept of ‘belief’ as the propensity to choose a particular course of action. (shrink)

Much has been written on the pragmatic maxim introduced in the 1878 essay 'How to Make Our Ideas Clear'. It was not there so named, but a quarter century later, at the outset of his Lectures on Pragmatism delivered at Harvard in 1903, Peirce quoted it and named it.1 At the conclusion of those lectures occurs another statement named a 'maxim' and implied to be pragmatism's. This 1903 maxim is almost as well-known as the 1878 maxim but has received little (...) comment.2 Was it only a figurative expression of the original maxim? That view cannot survive a careful reading of it and of the lectures which it concludes.3Neither maxim states a theory of meaning, but each implies... (shrink)

Over many decades, Richard Bernstein has interpreted contemporary philosophy’s three traditions, roughly distinguished as analytic, pragmatic, and Continental, emphasizing their mutual affinities. Despite this reference to the continent of Europe, it would be wrong to identify any of these traditions geographically or linguistically; even to call them ‘traditions’ is stretching a point. Pragmatism originated in Cambridge, Massachusetts, but it has spread from there, transmogrifying in the process and claiming surprising allies, such as Heidegger; the label ‘pragmatist’ has even been affixed (...) to Hegel!
